Welcome to Rambam In-Depth: Hilchos Bechoros, Perek 7, Halacha 5. Can a tithe that doesn't work still make something holy? The Rambam says yes — and his own novel ruling on Maaser Beheima explains exactly how. The Rambam paskens that you cannot tithe animals born in one year to cover the obligation of another year — just as you can't tithe old produce to cover new, or new produce to cover old. This is derived from a hekesh: the Torah compares the tithing of animals (Maaser Beheima) to the tithing of produce (Maaser Dagan), each of which must be done year by year, independently. But the Rambam adds his own chiddush: if someone did tithe an animal from one year to cover another, b'dieved (after the fact), the tithing is valid — because of the chumra of kodshim. That's surprising, because the same leniency does not apply to Maaser Dagan, where a cross-year tithe after the fact is invalid. So why is Maaser Beheima different? The Sefer Shittah Mekubetzet on Pesachim resolves the contradiction with a novel idea: Maaser Beheima actually carries two separate dinim at once — the din of maaser (the tithing mechanism itself) and the din of kodshim (the sanctified status of the tenth animal, like a shelamim, a peace offering). Even when the maaser mechanism fails across years, the din of kodshim operates on its own and gives the animal its holy status regardless. 🔎 In this video we explore: Why the Rambam forbids tithing animals from one year to cover another The hekesh that ties Maaser Beheima to the laws of tithing produce The Rambam's own chiddush: why an invalid tithe can still be valid b'dieved The key difference between Maaser Beheima and Maaser Dagan after the fact How the Shittah Mekubetzet resolves it with two separate dinim in one mitzvah Why the tenth animal carries the kedusha of a shelamim, a peace offering ⏱️ TIMESTAMPS 00:00 Introduction: Rambam Hilchos Bechoros 7:5 and the law of Maaser Beheima 00:18 The comparison to tithing produce — old for new, new for old 00:40 The hekesh, and the Rambam's own ruling: valid b'dieved because of kodshim 01:15 The question: why is this different from Maaser Dagan? 01:41 The Shittah Mekubetzet's answer: two separate dinim in one mitzvah 02:07 Resolution: why the chumra of kodshim gives the tithing independent force 🙏 If this chiddush opened up a new way of seeing Maaser Beheima, hit subscribe for more shiurim like this one, and share your own questions on the sugya in the comments below. 📚 Sources discussed: Rambam, Hilchos Bechoros 7:5; Shittah Mekubetzet on Pesachim; Maaser Dagan #MaaserBeheima #RambamInDepth #HilchosBechoros #TorahStudy #Halacha #Kodshim #RabbiGreenberg *Join our vibrant Torah learning community:* 🌐 *Website:* https://www.rabbigreenberg.com 📚 *"Jewish Wisdom for Modern Life" - Latest book:* https://a.co/d/6Sz88At ▶️ *YouTube:* https://www.youtube.com/RabbiHeschelGreenberg 📸 *Instagram:* https://www.instagram.com/rabbi_greenberg 🐦 *Twitter:* https://x.com/Rabbi_Greenberg 📘 *Facebook:* https://www.facebook.com/rabbihgreenberg 🎵 *TikTok:* https://www.tiktok.com/@rabbi_greenberg 💼 *LinkedIn:* https://www.linkedin.com/in/rabbihgreenberg
